my son is 16 1/2 old.my mother has custody of him because we all moved out of the country 3 years ago,and he missed his grandparents a lot and i thought he was having a hard time adjusting to the new enviournment,so i decided to let him spend the summer with his grandmother.anyway,once i sent him she went to court and told them she didnt know where i was.they gave her custody because of that.now,i am back in the states and he is giving her a hard time,skipping school,drinking,ect..she wants him to return to me and i want it too.the only thing is we are almost 3 thousand miles away from one another.she has purchased a ticket for my husband to pick him up in a few days,but she has not had the custody switched over to me.i guess my question is once he gets here,can i then apply for the custody although we are not in the same state?

ok,the reason why she has not had the custody switched over to me is because she is elderly(74) and has not transportaition to go and file the papers.she said once he gets on the plane she doesnt want him back in her home to live again.

BTW you are a LIAR!! Busted! You asked a question 2 months ago stating you fled your abusive husband who got custody of your 2 kids while you were out of state (next question you had 4 kids!) Get a life! I hope whoever has your "kids" keeps them away from you...what a thing to lie about...

Hire a lawyer asap. find out your rights. But he is old enough to choose who he wants to be with. If he is acting out that may change things. Of course he is acting out, look how he has had to live. Also if you get him..You need written permission from his grandmother to treat him if he gets hurt etc...

He's just visiting you. No sense getting custody, he'll be gone before the court date comes.

well the way it sounds she had no problem going and filing the papers for custudy the first time, so why should she now.
Yes you can file in your state.
