He has 2 older children that proved to be his. She holds the younger child (the 3rd one, not his) over his head as a reward to see her. He wants to adopt her but, she won't let him and still can't find her real dad... She has just said he will never see her again. She also kept they kids in a homeless shelter the other night because her and the boyfriend were fighting. He is trying for full custody but that means he only gets 2 kids not 3... :(

If you live in the US….

If they were married when the child was born or his name is on the birth certificate or he’s paying court-ordered child support, then he doesn’t need to adopt the child because he’s already the LEGAL father, and has all the rights of a legal father, including the right to petition for and be awarded custody/visitation. Of course, he’s also responsible for paying child support in the event Mom is awarded custody.

In that situation, even with a dna test showing he’s not the biological father, the only way he would lose his rights as the legal father is if Mom petitioned the court to disestablish paternity and the court agreed to allow that. Given the situation--he’s taken care of the child for 6 years, has bonded with the child, wants to continue to act in the role of father--chances are extremely slim that the court would allow paternity to be disestablished.

On the other hand, if he’s not the legal father and not the biological father, then he has no rights.

Tell him to discuss the situation in detail with a local attorney.

To address the initial question: "Can a father sue a mother for taking care of a child for 6 years then finding out it wasn’t even his?"
If you mean can he get financial reimbursement for the money he’s spent on the child (because he thought the child was his), then 'no'. Many men have tried, and I've yet to hear of a single case where one has been successful.

if he can prove that he is the only father that the 3rd knows and he has been there from day one, and could prove that she is unfit and unstable am sure he would be able to get her also. if not full custody at least visitation so that he and the siblings can maintain their relationship. consult with a family lawyer. if hes on the birth certificate then he is legally that kids dad. even if he isnt ,if he can prove her to be unfit and the child sees him as dad and the real dad is unknown then he can still get custody.
