you wouldn't always need to be there.

the charges are brought by the state and whether or not you want to testify might not matter.

but if you don't want to pursue this, you should tell the DA involved so that he can move on with cases that can actually be prosecuted...

You need to go to court or the DA could issue a warrant becuz they are invest the case. When you get there tell the DA & judge you want him to get counseling but not a tpo.If you are both found together, while the tpo is in order the police could charge you as well. Contact the DA & tell them he needs help. But if you want him to stay away....keep the order in effect.

A subpoena is a Judge telling you personally that he wants you to attend court on a particular day. It's possible that the charges might be dropped but it's also possible that a witness warrant might be issued for you. You'll be arrested on the warrant and brought before a Judge to explain why you thought you could ignore the Judge's order (the subpoena).

You can probably persuade them to drop the charges. And you can try to forgive him and visa versa. But then you HAVE to get away from him.

If you just skip out on court, the DA will never want to help you again. A lot of people probably wish they could get the DAs attention and don't get it. So, take their offer to help you seriously, at least, and show up for court like you are supposed to.

Yes the charges will be dropped for him. In fact you will be the one to look like the nut. You need to go to court and tell your lawyer what you want. The next time you may not be able to physically make it. They never change, they only get worse.
