most cities in Texas make it a civil offense. has to do with who gets the money from the fine, and whether or not you have the right to go to court and confront your accuser. also, in Texas when it is a civil offense you get no points on your DL, and the insurance companies do not know so they cannot overcharge you even more than they do already

It is a traffic offense/Infraction. Punishable by a fine. Pay your fine and obey the law.

CA... infraction just like being caught by a uniformed officer.

If you do not show up for court or pay the fine it will be criminal, even if it is civil at this point!

I have a feeling it might be a misdemeanor in some circumstances, but I'm not sure.
