OK, im 16 and what happends if a 20 year old hits me and i end up kicking his @ss. what will happen to the 20 year old?

will he go to jail?
can i win the case?
if he hits me first will i get in trouble for kicking his @ss because im 16 and he is 20???


i need info! please

First, to dispel rumors, its NOT child abuse for an "adult" to batter a minor / child unless there is a custodial situation, ie, the adult has some custody over the child such as a sitter or other guardian or caregiver.

Next, the situation you describe is an Affray, ie, consented mutual fighting. If he were to attack you, his only crime is simple Battery. If you fight back, its self defense.

So, there you have it.... at most, its either a battery or an affray. That is the facts.

First of all what State are you in? Most States if anyone 18 years or older assaults someone under the age of 18 years that could lead to a charge of abuse of a minor, child abuse, assault and battery etc.

In some cases it could be mutual combat, if there were no weapons involved. If he were to hit you first, and you cleaned his clock, I would say that would be self defense, as long as you didn't beat him half to death.

In any case you both could be jailed for fighting in public and disturbing the peace.

Well when he hits you it is assault and battery, when you hit back it is self defense, but self defense can only go so far, if you go so far as to "kick his ***" you can be brought up on charges also, most states allow for self defense, but only to the point of protecting yourself, once you have them beat down and don't stop you have become the criminal and not the victim.

There isn't any other Way to resolve the problem the 2 of you have?

What you describe is called "mutual combat". The person who initiates the fight can face charges for assault and battery. The other party's action can be excused as self-defense. But, that party must use only enough force to induce the assaulting party to abandon the assault. In other words, don't respond to a punch in the jaw with enough force to maim the other guy.

If he hits you and you defend yourself, then that is self defense. Accidents happen though, what if you hit him back and he dies?

both of you will be put in jail for battery and domestic violence. unless you have witnesses that can say that he started it.
