My ex is currently owes over three months in back child support. He just stopped paying and has had every excuse in the book. He is getting ready to go back in the army after ten years out. Will the army let him re-enlist and leave if they know he owes this money? I am currently awaiting documentation back from the court in regards to this matter, and was planning on taking it to an attorney. But now I am afraid he will be able to get out of town before I can do this. Do I need to make the army aware of this? Will it matter to them? It is a violation of a court order.

Hun to be really honest IF he is going back in then all you need to do is submit the court order and the military will deduct his money BEFORE he ever sees it, so that would be a great thing.........plus your children would be totally eligible for tricare [not you] as they will then go onto his page two and deers.........

regards and yes a pain in the butt having that wait period but just think at least you will KNOW it is gonna come every month from then on.

Just to point this out...
If you let him go and then inform the Army about his child support...
...you WILL recieve it and they will take it out, right off the top for as long as he owes it.
If he's single, they will even give him certain allowances and then take out the money which might even increase what amount you are authorized.
Additionally, if he qualifies for a bonus, you will be sure he has the money to pay the back child support after Basic (WTC) and AIT (if re-classing).
I say let him go and then have the court send orders to his unit.
You will very likely get the money.

you need to get the documents of how much he owes and take it to a lawyer. I'm pretty sure the government will take it out of his paychecks for you, you'll need a court order though. Even if he leaves the state with the military, they will know exactly where he is. Your lawyer will be able to help with what channels need to be followed to get the money withdrawn from his checks. (Which they do no matter what your job is.) The whole army thing will probably help you get your money because he can't hide his income in anyway and he can't hide where he's living from the courts. Go see your lawyer now because the sooner you get the ball rolling, the sooner you will get your money.

Owing the money will go against him if he is trying to get in the Army, but if he is an otherwise good candidate he will get in. This is GREAT news, however, your children will get medical and dental, and the Army will garnish future child support directly from his paycheck and send it straight to you. They will also garnish him extra until the back debt is paid. You should be glad he is going into government work and hope that he gets in and makes it. Sounds like the discipline the Army has to offer will be good for him too. It might not seem like in right now, but this is GOOD news. If you pursue the child support from the Army directly after he is in, things are going to be better and easier.

As long as there is no warrant for his arrest, yes he can. Happens all the time.
BTW, why should you care if he goes into the military or not? He will be getting, (along with the children) a paycheck, and all sorts of other benefits.
Don't worry about the military not making him pay his support, believe me, they will make sure he does.
Sounds like you want to make life for him a living hell because you still carry anger. Let him get a job and back on his feet!

Actually yes he can-he does not have charges pending against him and that is a good thing for you. Once he is back in contact the Army and they will force him to take out an allotment to provide the money that you are supposed to be getting. The military is actually one of the easiest ways to track some one in and they are serious about support payments for children. Get the papaers and take it to a lawyer and they will tell you roughly the same thing.

If he's re-enlisting, he's probably looking at getting a pretty sweet bonus. I'd let it go... let him enlist, if he can... and once he's in and gets through boot, submit your court documentation the legal office.... and they'll make sure you get your money out of his bonus... or pay... and they'll probably force him to set up an allotment to cover the child support expense every paycheck... which would be sweet for you!

If your court order states he can not leave town then he would be in contempt. Other wise he can go anywhere in the world.

Sure he can , they will take it out of his pay............ I have friend who gets her monthly child support checks ...and he is in the military....... at least she gets them that way

Domestic issues are not a top priority of the US army. Do you honestly believe the army will hold up the war while you collect back support payment ? I think not.
Your lawyer should know the procedure of putting a brick on his check no matter where he is. I wouldn't panick at this point.
