After 5 weeks, it's your problem. You were the one in control and care of the dog. You should have gotten a checkup and a booster if needed by that time. The dog didn't die on their watch, it died on yours.

IF you bought the dog from an ethical breeder and if the dog died from an inherited defect and if the breeder had a contract saying they would guarantee the dog from any inherited defects....then the breeder should stand behind their contract and if they don't, you would have grounds. If the dog was vaccinated and still caught something that killed it, well, that is not the breeders fault and it does happen. Also, after 5 weeks, unless the Vet can pin point it down to something that the breeder should be responsible for, that is too much time away from the breeders that anything could have happened to cause the death. Most reputable and responsible breeders will suggest to you that you take your new puppy to the Vet within the first week to have it checked over.

depends if you had a contract with the seller
reputable breeders offer 1+year of health guarantee
but if this "seller " was just a seller and not a reputable breeder then no you cant get money back
also it depends on how the dog died.
for example if he drowned, or was hit by a car then you are responsible not the seller or breeder.
but if you had a health guarantee and he died due to health ( that the breeder was responsible for) then you will be given back your money or whatever else was outlined in the contract.
if you dont have a contract it is your loss and you got your dog from a puppy mill or back yard breeder

You'd have to have testing done to prove what the dog died of. The dog could have had all it's shots and died of intussusception or another serious illness that's not related to what the shots prevent.

If your dog died of something that the shots should prevent, then MAYBE you have a valid suit, but it really depends on all the facts, especially what the dog died of and what shots he had and on what dates he had the shots. Dogs have to have a series of shots as puppies, not just one set of shots.

That would probably be considered "frivilous," but you'd only have a case if you could prove that the seller said that the dog had had shots like shot records, etc. It would also depend on what the dog died from and if the shots would have prevented it.

Did the dog die from something it was supposed to have a shot for? Like rabies? Were you provided proof of shots?
