Your story has some facts that I need, but I will give you the bottom line answer.

Child custody and all other family court issues (like divorce) are civil court issues. The police only deal with criminal law. Even with a court order, the police CAN NOT 'enforce' a child custody order any more than they can enforce a divorce decree.

They can only be sure that the child is not in danger and they can at best originate an Interference With Child Custody report.

What YOU need to do is to contact the family court and judge that issued the order. If the judge feels that the other party has violated the order, then that judge can issue a criminal summons or even a warrant for the other party, and that has teeth and the police can then take enforcement action.

You need to talk to a family law lawyer.

I know it blows, and I feel for you, but this is the law.

If you have custody of the child, then file a report with the cops in both New York and Oklahoma. Be prepared to show the Oklahoma cops all your paperwork showing custody, then go and get your child. You can have an OK cop go with you.

Take your paperwork to Oklahoma and get your child from school, and while you are there, file a felony complaint against her under Okla. Stat. Tit. 21 § 891.
