They can't fire you for being on the insurance - but they CAN fire you for not being at work. They aren't required to hold your position open for you.

It doesn't stop/cancel the claim, though. So your medical payments would still happen, until the injury is resolved, and lost wages would still be covered, until your doctor releases you to work.

Well no company can fire you for getting hurt at work. That is a law. Second if you are out too long and can not give them a good idea of when you can return to work they don't have to hold you job. If you are out for 2 weeks, a third should not be a problem. Its when you are out for months then it can be a problem

My guess is you had to take a drug and alcohol test after the accident. Had you flunked it then in retrospect you would be responsible for the accident. If all was clear no they will not, and cannot fire you for getting injured on the job. A thorough investigation should have been done as to why the accident happened and a report made, and if needed changes to procedures in performing the task in which you got injured.

They will not fire you while you are on worker's comp. regardless of how long you are out sick for as long as you have not recovered. After you recover, you come back to work business as usual. My father was on worker's comp. for 3 years and his company kept his position open for him while he was recovering from a surgery and a long therapy.

If they fire you while you are out on worker's comp, get yourself a good lawyer. You are protected by law.
