Here is the story. I was driving with a friend who had been busted a few months earlier for drug possesion. Before that and especially after, the officer stopped my friend every time he saw him, no matter what. Only found anything that one time. So, he sees us and asks what we are doing. We tell him and he lets us on our way. 1 block later, he pulls us over, doesn't tell me why, searches us and the car (w/o asking) and puts us in the backof his car. he finds nothing. I have no record and have never been arrested. For some reason he kept saying I had been mulitple times, but it is not true. However, my friend was on probation. is that probable cause to search MY car and ME? Also, the same officer has pulled me over several times since then. If he sees my car, he stops me and searches me. The last time he asked. He has never found anything illegal and says he pulled me over for something like signaling late before a turn. Is this cop doing this stuff legally by the book?

Technically you can have an arrest record or rap sheet even though you may not have ever been booked into a jail. If the officer detains you for any reason but then lets you go a record is still made that will show up on any background check (such as by an employer). Getting put in the back of a cruiser is not something that normally happens to honest, everday people.

I don't know if that is probable cause, but if an officer wants to search your vehicle and you decline you are going to be in deeper doodoo than if you just said OK. If you decline a search they automatically call for backup, 2 or 3 cruisers show up and a dog is going to sniff your car.

Maybe you shouldn't hang out with this person anymore.

Nope every cop needs a reason to pull you over and if its not a trafic violation or insurance then they illegaly pulled you over.Second call the police let them know you just got pulled over by an officer who pulled you over two blocks ago and is herassing you letting you go and pulling you over again while he is next to you.
Second, remember the time and date all cops have a computer that automaticaly records that info that way if he denies you can you remember and give detail.

if it is a pretty good sized police department, file a complaint against him. He should get investigated by Internal affairs and once that happens, he will have his own record to worry about when it comes time for a raise or promotion,, hell, file a few complaints on him.
