Since a legal separation does not constitute a divorce, then you are still married.
Hence, sex outside of marriage is still called adultery.

But "dating" while separated is only unethical.
Adultery implies a physically intimate relationship.

I read most of it but getting involved and starting anew isn't wise. YOu haven't even resolved the issues of your marriage. Adding new people just makes it more complicated for you and everyone. It's easy to get wrapped up with some new lover, when you feel bad. I think you need to clear your slate and figure out your marriage. Ever think about bringing a new man into your house with your daughter there? What kind of example does that set. Your heart and head are all over the place. Be alone and clear your head. Before shacking up with MR. Good bar. It's not fair to the new guy or husband. At least have a clear head so you can make a good decision.

Me and my wife are not legally separated or divorced and she has another boyfriend that's there with my 3 kids all the time only one moth after she asked me to leave is that legal ?

Yes. Many judges will award the children to the other spouse if that spouse brings forward the dating while still married issue.

Yep.

Biblically, whomever you first have sex with is the one you are "married" to. You can legally marry someone else, but if you do -- you're committing adultery every time you have sex with your legal spouse! Ain't religion fun?

If by "date" you mean "have sex" then yes, it is adultery. Couples who are legally separated are still married.

Dating while legally separated is not adultery NOT adultery. However, if you have sex with someone besides you mate while legally separated, it IS adultery.

Whoever you have sex with 1st, is at least biblically your spouse for life.
