It depends. Did the person have an active outbreak? If so, then they are highly contagious. If not, then you have a better chance of out being infected. Asymptomatic (no acteive outbreak) shedding is believed to occur on 2.9% of days while on antiviral therapy, versus 10.8% of days without

People with herpes are only infectious for a fraction of the time - depending on whether he has type 1 or type 2 herpes this would vary between 3-15% of the time. Most of this time is when symptoms are actually visible. So the chance of catching herpes if he didn't have visible symptoms is very very small.
If symptoms were visible, there is a high risk, but it is still not definite that you would catch it. If you haven't developed any symptoms within 2-20 days of sex (generally within the first week) then I would say you were pretty safe. I knew within three days that something wasn't right.
You are no more likely to catch genital herpes from a partner who is infected but does not have symptoms than you are to catch cold sores on your mouth through kissing someone who gets them but does not have one when you kiss them. The risk is there still but is very small. In fact, you are as likely to get genital herpes from receiving oral sex from someone with oral herpes, if you do not have cold sores yourself. Every girl I know who has genital herpes, including myself, has hsv-1 caught through oral sex with a partner with cold sores (my partner didn't actually have one at the time). It is actually very unrealistic to aviod people who have herpes of one variety or another - since 80% are infected with type 1 on average and 20-40% dependent on age with type 2, you are bound to have partners who are infected whether they know it or not (the majority don't know but can still be infectious). Whether you catch it is partly just down to luck.
Genital herpes is very common - one in four women and one in five men have it - so there is actuallya good chance you have already had a partner with genital hepres aside from this one. It doesn't follow that you will catch it at all.

herpes is spread easily. The virus from contact with an infected person can enter your body through a break in your skin or through the skin of your mouth, penis or vagina, urinary tract opening, cervix or anus. Herpes is most easily spread when blisters or sores can be seen on the infected person. But it can be spread at any time, even when there aren't any symptoms.

If you only had sex, then you will only get it below. If you did more than that, its possible that you will get it in your mouth. There is no treatment. You can contract it even if the person wasnt experiencing an outbreak. Be very careful!

Get tested. There's a 50%/50% chance that you contracted the disease. I hope you don't have it. (ALWAYS WEAR A CONDOM OR TELL YOUR PARTNER TO!). And don't do oral.
