I had an experience with a local new police officer in my town. My husband was caught driving on revoke lieance about 5 houses down from where we live. My husband, which was in the wrong told the police officer that he was going to drive 5 houses down and pull my truck in the drive way because i needed it to go to the hospital to be with my daddy but the officier told him no but my husband shut the door and drove about 15 miles per hour and pulled in the drive way and just sit there for the officier to arrest him. I was standing out in the yard and instead of the officier going over to the truck to my husband, he jumps out of his car and starts running at me with his gun pointin on my chest, because they have the red dot that shows them where they going to shoot, and screemin at me like i was the one violating the law, and here i am standing in shock afraid hes going to fall over a toy and shoot me or one of my kids was going to wake up and run out the door and get shot ..

Here are a couple of thoughts:
1. If there was a red dot, it was a taser not a gun. Cops don't use laser sights on their guns.
2. Sounds like your husband is in deep trouble. He went from driving on a suspended license to fleeing and eluding and resisting arrest without violence. Moved from a misdemeanor to a felony to save walking 5 houses. Not the best decision.
3. I KNOW we are not getting the entire story. If you were just standing there not saying a thing and complying with what the officer said, I don't believe he would have acted the way you described. I suspect you were yelling and not listening to the officer.

To answer your question, records of investigations are maintained by the internal affairs department. How much is subject to disclosure will vary by state law. I would start there.

You need to get a new husband, he's the one who put you in the situation not the cop.

To me, the cop appeared restrained, if someone takes off on one of my traffic stops, they will be facing down soemthing worse than a taser. As will anyone else in the vehicle or their buddies when they stop.

Face it, cop did nothing wrong;

If your husband hadn't been driving revoked this wouldn't have happened.
If your husband had obeyed the officer's lawful commands this wouldn't have happened.

Make a complaint, the PD will rule that the officer used acceptable officer safety during an eluding. You will also make some new friends-expect your husband to be pulled over each and every time he drives revoked.

I would have arrested him and towed your truck.

You break the law and admit to it, then break more and I will apply full police service.

Had the man just waited taken the ticket, I would have left the truck there.

I am as laid back as they get when it comes to police officers, but when I am lied to or have something thrown in my face its all over. I become evil cop, and will cite and arrest for whatever I can. All I want is the truth.

Let me get this straight. Your husband was pulled over and caught driving with a revoked licence, then he ignored the officer and DELIBERATELY drove away from the police, into a driveway, and you want to make trouble for him? For all he knew, the perp who ILLEGALLY drove away was going for reinforcements from his gang, and you want to make trouble for him? Your husband is lucky they didn't shoot the tyres out on his vehicle as he drove away!

ERIC ... did you ever consider it is not your job to gather TRUTH .. No citizen has an obligation to tell you anything and should not tell you anything. All the talking needs to pretty much be done between our ATTY and YOU.

THe role of the COURT is to determine the truth.

You will be thrilled to know your job has now been cut in 1/2. Focus on the important details .

I am thrilled you are laid back. Work harder you have 50 percent more time now that TRUTH GATHERING / TRAFFIC STOP HUMAN LIE DETECTOR TESTS are out of your job description !

What a terrible experience. But trying to prove that "one of their own" did anything wrong will be hard to prove. Too bad a neighbor or someone didn't witness it.
