Scenario: A teen is given a neighbor's key to feed the cat while they are away. One night he invites over several friends for a little "party" the people who owned the home find out and file a police report. All kids are questioned about the party. Can all be charged with burglary/unlawful entry.? Or is it solely the boy "who had the key" his responsibility? It is not as if anyone broke in/kicked down the door or forced their way in. Any insight?

Burglary is defined as entering without permission with intent to steal. At this point, there is no intent to steal. Based on the fact the teen was giving a key, that permission would most likely be implied to include his guests. If there are other violations of the law, the person with the key could be held responsible along with the person who actually commits the violation.

No law was broken by having the party. If there are things missing from the house, charges, including burglary/theft of property could be brought. All paries involved would probably be charged. Those found not guilty would be released from liability.

Since the original child had the key and permission to enter the home, I believe he can't be charged with trespassing.

BUT, the other children were not invited by the homeowners. They could be charged with trespassing. The original child with the key could be charged as being an accomplice even though it was his dumb idea.

the kid with the key is the only one that WILL get into trouble, for he is the one with entrance abilities, and the other may not knowledge that the house is not his. ummm... the others may get warnings or insight from police that parties are unnecessary at their age. maybe thats all. but yeah, only the kid w/ the key will get in trouble.
If a file is reported to police, then the one with the key may get into trouble. not absolutly trouble though.

Sounds to me like more of an ethical issue that should be resolved between the families. I don't know why people insist on bringing the law into every little thing anymore. And people wonder why they have such a stronghold on our society..

I would hold the responsible boy soley responsible, and his parents.
