Hello,

I filed an I-130 petition for my sister, her husband and her daughter a few years ago. While waiting, my sister have another baby. How do I add this new born to the petition I already filed?

You don't have to add anyone to the I-130 petition. The petition automatically covers your sister as the principle beneficiary, her spouse and any children she may have, as derivative beneficiaries, now or during the 10 years or so it takes for the petition to become valid. As you might imagine with a waiting time that long, this has happened before, and many other things as well. When it's time to be interviewed, they'll need to show a birth certificate for this child and any others that may come along. Of course, the more children they have the bigger your affidavit of support will need to be. If the petition has been approved, it should be at the National Visa Center by now. But they won't take any further action on it until it gets close to the priority date, the date it becomes valid for use.

You need to file an I 130 for every person you are petitioning.

It can take up to 20 years for a Visa to be granted to a sibling.

You cannot "add" another person to an I-130. You may file a separate one for the baby.

At this point you cannot add anyone to that I-130, but when its time for your sister to go for an interview she can add this child and that child and any children of hers under the age 25 will accompany her. Keep in mind this may take up to ten yrs, wish you all good luck

You need to contact them and inform them---they'll tell you what to do.....
