The city tax I found out from my employer were a mistake and SHOULDNT be taken since I dont live or work in the city of NY only the STATE. So how do I go about getting my City tax back since when I filed my taxes I didn't get a refund for my city tax?

You can file amended returns for all three governments.

I would file an amended return with the city first, and include documentation showing why you should not have paid tax to them. Once you get a refund, file amended returns with the feds and the state. You'll probably have to pay a bit more when you do, though, but unless you paid a huge amount of city tax, it shouldn't be too much.

DId you file a NYC return? That's the only way you'd get it back - the feds or the state aren't going to give you the refund for the city taxes, since they didn't get them in the first place.

One thing to consider may be how you used Turbo Tax... If you bought the software and loaded it onto your own computer, and got a direct deposit refund, then it seems like your rebate should go directly to your bank account. On the other hand, if you used their website, and processed your return through them, then you will get a rebate check. Another thing to consider is how the refund and fee were dealt with - On our tax prep software we can designate up to three different accounts that we want the refund sent to. I'll bet if you owed Turbo Tax a $150 fee and were expecting a $1000 refund there are two ways they could handle it. If they put the $1000 refund in their account and then transfered the $850 to your account, the IRS will send you a rebate check. If they put on one line that $850 should go to your bank account and $150 should go to their account, it may be that the IRS will send you the rebate direct deposit.

If you filed taxes for NYC then you answered the questions about living and working there. If you filed correctly you should get a refund. If it was incorrect then you will have to amend your return.
