Or if its not illegal can you get in trouble for it? Wouldn't it be a part of your 1st amendment rights?

I've been flipped off and called names and sworn at etc. It generally comes with the job. If it makes you feel better and all grown up, go ahead. I was standing with a partner of mine one time and a vehicle full of teens drove by and yelled out the window and flipped us off. My partner jumped in the patrol car, pulled them over and located several violations that he cited them for. I find it interesting that they chose to draw attention to themselves. It was just as if they said, "Please officer, write me some tickets."

Contrary to a couple of the answers...yes, it is illegal in many places. Not just to the cops...but to other people. It falls under obscenities, which some states, and many municipalities have laws about. Regarding the First Amendment, no, that does not protect obscene speech. It was written to protect unpopular political speech, and until fairly recently was not construed to protect more general issues of "license". Often these days nothing is done about obscene speech or gestures because it is so common. That does not mean in any given case, nothing *could* be done. I think in public places, it should be cracked down upon, because we are getting to where there is a sense of lawlessness...the hip-hop punks feel like they can stare anyone in the face and say anything without retribution. This also ties in with the question of censorship and "artistic license". Yeah, go ahead and produce your filth. That doesn't mean it should be legal to sell anywhere. Any society that is going to maintain any semblance of order has to have lines somewhere. If you claim that the First Amendment is all-encompassing, without limits...then there are *no* lines whatsoever. It's pretty clear that cannot last, nor was that ever the intention.

You know kid, this question gets asked at least 3 times a day. Make the effort and first do a little research on Yahoo Answers before wasting your 5 points on asking a question thats already been answered about 1000 times. No, it isn't illegal. But the cop will probably follow you around and look for something illegal, and chances are he's going to find it.

In Ohio it could be interpreted as disorderly conduct. Ohio Revised Code 2917.11

(2) Making unreasonable noise or an offensively coarse utterance, gesture, or display or communicating unwarranted and grossly abusive language to any person;

OR

(5) Creating a condition that is physically offensive to persons or that presents a risk of physical harm to persons or property, by any act that serves no lawful and reasonable purpose of the offender.

Here, it could be fall under disorderly conduct. I've been flipped off more than once. Never charged anyone because of it, though.

If someone has that many problems in their life they feel the need to show me the bird, I guess I just feel sorry for them.

It depends on the context. It can be perceived as a threat, a challenge, resistance, etc. Why would you anyway? If you've been wronged and you do something like that, you've completely invalidated your argument and just look like a disrespectful jackass. Argue your case with the judge, not the cop.

actually it is not illegal at all, but it is rude and wrong. plus, if you piss off the police officer, he or she may find every reason possible to make your life miserable. (that is unless you are in LA or Chicago where they might just beat the crap out of you - just because ... ha ha ha ... just kidding officers)
