We never got any joint account. But the car dealer has been calling and leaving messages. He also made several long distance phone call to his mistress. That account is under his name. What could I do? Am I responsible for those accounts? Please help. thank you

Sorry to hear about your situation. As others have already said, talking to an attorney to determine what you are and are not responsible for is the best call.

What’s good to see though is that you are immediately paying attention to finances. When people go through divorce or a spouse passes away, there are a lot of important decisions that need to be made. Unfortunately paying bills and managing finances are often forgotten in the fray, and credit gets unnecessarily tarnished.

Divorce him and talk to your divorce attorney about this. If your name is not on the accounts, you will likely not be responsible for them. Eventually he will come back here, and his credit will be ruined. In any case, you are going to want to talk all of this over with an attorney, rather than trying to get advice here. Good luck!

It will probably fall under marital debt when you file for divorce
but he is responsible in the meantime, If you can't make the
payments do a voluntary default and make sure the Dealer
only puts in on HIS CREDIT REPORT not yours, make sure
you have his Social Security Number

If your name is not on the accounts you are not responsible. You need to let them know that when they call, your name is not on the account your husband no longer lives there and they need to report it to a collections agency.
If your name is on the account, then you are also liable. make sure your name is not there as a cosigner or anything before sending them to collections

You need to consult a laywer A.S.A.P. California is a comminity property State so you may be responsible for some of your husbands debts even if your name is not on the accounts.
