not my child but a child i am close to was pulled out of class and searched cause another student said he had drugs. he didnt have drugs. hes a freshmen, new school. didnt have a history in middle school. i understand school has right to search the child, locker even their cars. but something like that i feel parents should be called and told about this. am i the only one that feels this way? if it was my child i would be upset cause school didnt inform me.

hes only 14yrs old and it was done by the school cop. which is a real cop but is in charge of the school fights, drugs, etc. my children came home and told me the boy was searched. i called his mother and she had heard nothing from the school of this action. school has the right to search. with all the crime on the students and drugs they have to make it safe. but i feel very strongly that parents should be told. even if he didnt have drugs on them or a weapon parents should be aware so they can further the search at home, get the child help if needed. i think the schools think its their job to raise our children not teach them. i know growing up my parents would of went off on someone for this. and maybe thats why i feel it is so wrong

When I was in high school, we had similar situations. The school cop was allowed to search anyone's locker or book bag at any time without your permission, but if they had any given reason to search you (and it had to be more than some kid saying you had drugs) your parents were notified. They'd tell the parents that they had evidence against their child and they had the choice to either let them be drug tested/searched in school right after the last bell or they could personally take them to the station within 12hrs and have it done there. If neither was done, the child would be suspended flat out.
I do have children of my own and taught in a high school for two years. In my own personal opinion, I feel as though this was a joke against a freshman. I had one student suspended for setting up a younger student of drug possession. If a student ever fell asleep in class, I was suppose to send them down to the nurse to be drugged tested as well. The parents were only informed if the test came out possitive or if the student refused to take it.
If this happened with my own child, I would have a fit if I wasn't informed. To pull my child out of class and have him personly searched in school without my knowing? What if God forbid he does have drugs. I'm sure it would make parents THRILLED when they get the call saying "Hey, we searched your kid without telling you and we found drugs." Wonderful.

This is the gist of what I read from our school handbook just now: The school can search any ones locker , desk, car or backpacks at any time because they are on state property. Basically, they can do this to any child or teacher and they don't have to notify anyone. HOWEVER, they may not search the physical body or clothing, or the removal of shoes without a police officer involved and then the parent will be notified in writing.
Anyway, our middle schools and high schools make parents sign a paper stating they understand and will cooperate with the schools in incidents of a search.
Read the student handbook, because if it's in there then the schools will argue that the parent knew the rules.
I do think the parents should be notified of anything out the ordinary at school, including locker and backpack searches, but that isn't the way it is here, either.

I would be very angry if a school searched my child without my presence or permission. The police are not allowed to search or even question underage children in my country without the presence and express permission of the parents, so what gives teachers the right to do so just on the say so of another student? In the absence of any permission, AND of any other evidence pointing to the child having done so, I think that searching the child is just wrong.

I think the parents should be called it would upset me im glad they do search nowdays they have to schools are getting so bad but damit they are still are kids they act like they own them unless it is something bad then your in court and it is your fault. Maybe if they would call us about the things our kids do we could help resovle the issues. The only time a school will contact you you is if your kids are sick and not there for them to get their money that day.

I do not believe the schools have any legal right to search like this without the parent's permission and/or presence with their child. If I were this parent I would seek legal counsel.

Yes I would be upset let alone the child is humilated by the actions of the school in front of all of his friends.I would be down there this morning filing a complaint!Calling lawyer and calling the school board.

Whatever they need to do to make the schools safe is fine by me.


Everybody is so sue happy now-a-days.

What if they were searching for guns and found one? would everyone still be so gung ho about not being notified. Next time there is a scholl shooting and the student wasnt searched because the school didnt call his parents first,dont come crying about it.

What if drugs were found on the child? would it be a different story? If he is innocent and didnt have any I dont see a problem with him being able to "clear his name"

A child under the age of 16 cannot be searched without a parent/guardian present. make a complaint!

I think the school should be able to do this. But I agree with you that the parents should be notified, especially for younger children.
