Selective Service System which is a Federal agency and carries out this function under regulations which flow from the Universal Service and Training Act of 1947 (as amended). Although the requirement to register for Selective Service is still in force, the power to conscript has been held in abeyance since 1973. We have an all-volunteer force and no change in that state of things is anticipated.

Congress and the President have the final say. Even though there is no draft presently, every 18 year old must register with the Selective Service. My son had to right out of H.S. And if there comes a draft, hear me roar, I will take him to Canada myself! We've had enough bloodshed in our families on both sides, not gonna have anymore! Call me what you want. Not gonna lose my only son. Period.

There is currently no draft. When there was one, it was carried out by the Selective Service Department.

It's like other governmental operations. Conscription laws are written by Congress and executed by the (gasp!) executive branch.
