When you get your license and sign it you agree to submit to chemical testing at an officer of the laws request. You also agree that refusing to do so is admiting guilt and is automatic lose of license. The punishment is the same for refusing and failing so they take there chances.

Plus taking the test alows for more fault to be found in the entire arrest and your lawyer has a better chance of beating the case. With failure to submit you make it impossible to determine if you were drunk or not so the guilt lies in you unwillingness to submit. Non guilty people have nothing to worry about so they would take it in the eyes of the law

Because if they do not, then, in most states, it is not only admission of guilt, but an automatic 1 year license suspension. Many states only have an manditory 90 day suspension for on a license for an OWI/DUI.

Above poster is correct, if refused, police can get a warrant and do a blood test so refusing, at best, is a stall tactic, but the results are worse than a guilty plea...even if you test under the limits, your driver's license is suspended anyway.

In Colorado it is a confession of guilt to a DUI if you refuse to use the breathalyzer. You will have a better chance in court if you fail the test than if you refuse it. Also, if you refuse the test you are carted off to the hospital for a blood test. Either way, they got ya.

To the question:
Three scenarios I have dealt with: They know they are drunk and concede that they are busted, they know they are drunk and think they can fool the test (shallow breaths or sucking instead of blowing; I'm serious!) or they think that they are not drunk or drunk enough and take a chance.

Most are intimidated by the implied consent laws that will suspend their license for a year if they don't.

It's like the lottery - if you don't play, you can't win. If you know you are drunk and take the test anyway, there is a chance of a malfunction, there is a (perceived) chance that you can fake it, there is a chance you are not drunk enough to be DUI - there is a chance (very small) that you will not get arrested.
If you don't take the test, there is no chance that you will get to keep your license.
You're already caught - may as well take a chance.

Because refusing a breathalyzer test is a crime in its self in most states. So in addition to being convicted of DUI you'd also be convicted of refusing a breath test which adds to your punishment.

Because of several reasons.
1). You will be charged with DWI even if you refuse.
2). If you refuse your license will be suspended for a specific amount of time (in NC it is one year for refusing).
3). If you refuse the breath test then you can not get a limited driving privilege.
4). The fact of your refusal can be used against you in court.

Don't drink and drive.

you're getting arrested besides. The question is what rates would be added against you. based on the state, the punishment to refuse a try is in many cases worse than the punishment for making use of decrease than the effect.

In some states if you do not they automatically take your license for a year. Others will take you to a hospital and draw blood at your expense.

In Canada they take away your license at the spot, take your car to the impound and you sit in jail until someone comes to pick you up.
