My neighbor backed into my parked car while he was trying to parallel park. He scratched my entire driver side door. I even witnessed to whole thing. I called police to make an accident report. My neighbor says I should call MY insurance company to report it if I want. He hit me....shouldn't he have to call HIS insurance company? Why would I call mine. Wouldn't I have to pay then. I shouldn't have to pay if he hit me right?

yes, his insurance company will probably pay for the wholoe thing but you should contact your insuance company no matter what. If the other guys insurance company tries to fight it you want them you call your insurance company and not you personally

You should call your insurance company. They should go after the neighbor to recover the cost of fixing your car. You should contact the neighbors insurance company as well.
At any rate, your company can advise you on the best course of action.
Since your car was parked and you weren't in it, it is probably OK to notify them. Sometimes, if you get a scratch that doesn't amount to much, you are better off not even filing a claim because they will jack up your rates or cancel you.

1; first, the best thing you did was called the police to report, so there is a record.

2; did you get your neighbors insurance policy info?
ie; name of company
policy number
phone number for claims
you will also need to know your neighbors name, the auto he was driving that struck you. that will validate if the auto is insured or not, or==if he is on the policy

3; since your car was parked, and he struck you, his insurance policy will owe for your damages.

4; i would hold off calling your insurance company until his company calls you. the policy states you are responsible for calling them, but in this case, unless he has no insurance, they should take care of it. some companies will "ding" you for any claim, regardless if you are at fault or not and your rates could go higher; some companies dont;

5; if you have his insurance info, hold off 24 hours before calling them. they usually have a 24 to 48 hours that they are required to call both the insured and claimant for details of the accident. they usually try and get the insured 1st, then call the claimant to verify details.

6; now, since this is a easy case of liability, his company once they contact you should have someone inspect your car, or they will send you to one of their repair shops or ask you get estimates.

7; if==after a week, you have no response from his company, then i would call your company to report. if you have collision coverage, your company will pay for the damages, minus your deductible. your company would then contact his company to subrogate the amount they paid plus your deductible. if he has no insurance, your company will go after your neighbor personally for the amount they paid and your deductible.

First Question: Do you live in a "no-fault" state?

If so, you report the accident to your insurer. As your vehicle was parked (legally) at the time of the accident, you're not at fault and so have nothing to fear for reporting the accident.

Call yours and if necessary your insurance company will call his. Don't sweat it. He should call his, but obviously he won't. And if the police report is accurate and your insurance company does pay you shouldn't have to pay the deductible.

You would not necessarily have to pay. My reasoning would be to let the insurance company (yours) handle it in the case that a suit would have to be filed to recover from the person that hit you. If he did not have liability insurance, and if you have collision insurance, yes, your insurance would pay to have your vehicle repaired. Then they would file suit to recover the amount that they had to pay out to fix your car.

Contact yours then send them the police report. They will make sure you get yours fixed then get the money from his.


Make sure your company knows his name, address and phone number and has a copy of the police report.

He is going to be difficult so get ready.
