I live in Caif and it was the other persons fault regarding the accident.

if the other person is at fault, his insurance company will either repair your auto or pay you for the value of your car;

if the repairs exceed the value of your car, they they will pay for for the value of your car pre-accident. no more, no less;

you cannot get more than either the value of your car or the cost to repair; whichever is less, is what you should receive.

The accident is going to be declared to be your fault, because you didn't have insurance and therefore shouldn't have been driving and had you not been on the road the accident would not have happened, the only exception to this would be if the other driver was commiting a greater crime than driving without insurance, lets say he was drinking or something. If the accident is your fault then the other person's company isn't responsible for you or your car, and if it is somehow their fault then their liablity covrage will take car of your car, most likely by giving you the blue book value....

Your property damage and payment for it is the other person's liability. By law, they have to pay it.

With that said, if other person does not have an insurance and if the other person does not have any asset, you are basically unprotected. In addition, since you don't have an insurance, you will have to do your own negotiation with the other driver's insurance company. It is not always easy.

More than likely, it won't REPLACE your car. It will pay for your damages up to the fair market value of the vehicle at the time of the accident. If you can buy the same car or any car at all at that price is actually not anyone's concern but yours.

Yes, the car can be replaced. However you will soon be learning the reason for carrying insurance. Not only will your fight to get your car be an uphill battle against the other person's insurance company, you will be bearing all of the costs involved in the litigation. The insurance company has attorneys on retainer and you will be forced to hire one to get your car replaced. It could cost you more than the car was worth and take years. You will also get fined, lose your license, and have to pay more for insurance when you do get it.

Man people don't know crap!! From the responses you received. If it was 100% the other persons fault then yes they will pay to fix your car. But you will probably get a ticket for no insurance. Which should be your choice anyway , weather to have insurance or not

if it was the other person's fault, then their insurance is responsible to repair or replace your car. You should expect to receive a ticket for driving without insurance, but it won't affect the settlement from the other driver's insurance. They must pay for your car damage any any injuries you sustained.

If you didn't have insurance you shouldn't have been on the road..if you weren't on the road the accident wouldn't have happened. If the accident didn't happen, you'd still have a car, which you could get insurance for..(:O)

If they have full coverage insurance then their insurance company will look at the minimal blue book value of your car and give you that amount in cash. If the insurance company can find a similar car somewhere that is cheaper than bluebook then they will buy you that one.

Probably not. The insurance company will only pay out the liability limits of the other person's insurance. If you want to get more out of that person, then unfortunatley you will have to talk to them if they are not willing to pay then you might have to sue.

Why don't you have auto insurance, isn't it required in CA?
