I have two friends, for the sake of argument, I will call them A and B. A is a US Citizen and B is here illegally. B has been here since he was a child, he tried to get his papers but was unable and was ordered to leave the country. Needless to say, he is still here.

Recently I have discovered that A helped B get a US passport under his name. All the information on the passport is A's but has B's picture on it. My question is twofold:

1. Personally I have no problem with B being in the US, even illegally. Now they have commited a crime and I am aware of it, what should I do?

2. How were they able to do it? A is caucasion and B is Hispanic; they look nothing alike. Does the passport agency not check anything before they issue them? I would have thought that somehow they verify the picture, do they not do that?

I realize that some of you will question my integrity since I am ok with him being here illegally but not with this new knowledge that I have come across.

I feel that he should have been allowed to stay and the grounds on which his application was refused was stupid, and I say so in the kindest of words. Not every law is perfect , they are written by man and I choose to not accept all of them with my eyes closed.

First...a response to your question!

It seems to me that as long as you're not "A"...you should have nothing to worry about. However, if you are "A" then you've committed an offense of Fraud against the government application which is a punishable offense.

Second...I have no problem with immigrants who come to this country legally. Those who come illegally, however, are already criminals for entering the country illegally and against the laws of our founding fathers.

One of the the key frustrations for Americans is how their own government has actively promoted illegal immigration by providing illegals with government benefits while the Mexican government is encouraging the exodus of its own people.

It is the cooperative relationship between the U.S./Mexican governments that is causing the problem, criminalizing the American people’s attempts to protect their families, their property, their way of life and their country from illegals; it is the same unified U.S./Mexico government policies that are strengthening the position of Hispanics who believe that their historic right to live in the U.S., particularly in the southwest, is greater than the right of the American people to enforce its laws with regard to residency, citizenship and illegal entry.

Illegal alien workers may increase profits for employers, but they are costly to the American taxpayer. Most illegal aliens have low educational attainment, few skills, and they work for low wages, often in the underground economy where they pay no taxes on their earnings. Since about three million illegal aliens gained legal status in the amnesty of 1986, the flow of illegal immigration has increased, and today that population is estimated at 9-11 million illegal alien residents in the country.

When the taxpayers provide medical, educational, and other services used by illegal immigrants, who a majority fail to pay the tax obligations to support those services, we the citizens lose our hard earned dollars that could be more wisely spent.

Lastly, if one wants to come to this country, come...legally...and be an AMERICAN!

Not sure about how they got the passport.

As to what you should do, you are under no legal obligation to do anything. Considering you already knew he was illegal, why did that not make you ask if you should call the INS?
As a prosecutor, I often find defendants are illegal. That does not affect the offer to settle the case. It does not affect the judges who sentence. We do not have an obligation to report to the INS who we deal with and in your case neither do you.
I know this will piss of some, but with 5-6 million illegals in California, the wheels of justice would come off and roll away. Consider the fact that even when INS picks people up, they usually parole them into the community until a hearing date that most of the illegals do not appear at.

Morally you should report it. However, you are not under a legal obligation to do so at this point. You do risk being hauled in as a material witness if person B ever is charged with some kind of heinous crime....

Not to be alarmist but this is one way that terrorists are gaining access to America.....at least consider reporting it anonymously to Homeland Security so they can investigate the office that didn't do its job. You've no way to know who ELSE they may have let in, que no?

You could try contacting the agency in charge of passport, they may cancel A's passport. As far as how they did it? That's not rocket science, obviously it's fake and not issued by a government agency. They have both committed multiple felonies.
