One of the flats in our building keeps leaving their rubbish in the street rather than the wheelie bins. We have received a letter from the enviromental health saying that we could be fined if it happens again. Would they have to prove who the culprit is, or could they fine the whole building. The building is freehold and is part of a Resident's Association.

You can only be fined if the environmental health authority can prove you were responsible. The Resident's Association will need to decide whether to shop the people dumping the rubbish.

They would have to be able to prove who is responsible and of course they would try and do this by examining the rubbish for addressed bills or letters. If they do that they will probably find some as people so stupid that they dump rubbish in the street when there is a bin will also be stupid enough to leave the evidence in the bag.

I think that it would be unnessecary for the Resident's Association to fine every person in the building.
They should just find out who litters via cameras or people saying who litters.

However, some people take littering too seriously, like a person being fined for giving a pigeon a chip or leaving an apple core on the floor.

I'm not sure identifying the culprit would be difficult. If checking the refuse doesn't do it, asking all the residents of the flat would likely narrow it down. The other residents would likely be more watchful, in an effort to make sure they don't get punished for someone else's actions.

It depends on the council, it probably wouldn't be too difficult to identify the culprit from examining their refuse sack, council workers deal with refuse all the time so this is just a slight inconvenience for them to do. Sometimes they try the old teacher trick, blame everyone to try and get the guilty to own up, doesn't work in today's society though!!

In responce to this letter inform the department in writing that you ensure that your refuse is placed in the bin, if you happen to know who the culprit is report them.
There are too many bone idle people who leave their rubbish about, they can be fined heavily for anti social behaviour and deserve to be reported.

If you were in England the Local Authority would be obliged to collect this rubbish. As you are in Scotland, with your own laws, rules and regulations and so on, it is probably up to you to move it.

Don't wast your time getting on to the police, they won't be bothered about this sort of offence, it's too much trouble for them . The best bet for this is your local council, they will sort it out. Just on the off chance that they don't, ring your local councillor, that lights a fuse under 'em !
