go to the unimployment office and file for it. i had the same problem. my boss told me my job was there after i healed, but when i was ready to return to work she told me she filled the position. i filed and i won the case. as far as getting your job back, dont count on that though. hope you ge ta better job next time. a job where there care about you. good luck

A surgery is not a disability.. disability would be mental retardation, lupus, cant walk ect.
If you were fired from gallbladder surgery, you do have legal rights but it varies in each state. First you have to prove that you were fired BECAUSE of missed time from the surgery, you need to make sure to have all your medical documentation handy, and have prove of what you gave to,s poke about and forwarded to your employer. You need to make sure that as best to your ability you showed and proved to them the procedure was happening and that you did not "extend the time you had off" without the doctors permission and /or note. Once you have all this you can go to a lawyer. Depending on the laws of your state, you can either get your job back or get paid for the loss of the job. But you need to make sure you have all of the above as proof.
