Do you tell them when they ask, or are you supposed to create a verbal contract the second you kiss or go on a second date???

Exclusivity requires "the exclusivity talk." One should not presume.

you should make sure that the other person or people know that you are not exclusive until you both agree to be exclusive, other wise the other person might assume, say your cheating when he finds out about the other guy and then you have a bloody mess on your hands
