My Soldier plaguerized off websites word for word on an essay and my NCO is telling me that she shouldn't be punished because I didn't tell her that she could not plaguerize. I had her write the essay for corrective training.

There is no "specified" Article 134 offense for this conduct. The closest Article is 133, conduct unbecoming an officer which lists as a specific example cheating on a test. However, your Soldier is not a commissioned officer. However, Article 134 can also be crafted to fit any conduct that is service discrediting or prejudicial to good order and discipline.I n this case, the "prejudicial to good order and discipline" is the more appropriate basis. However, I would not recommend to a Commander to pursue charges in a court-martial setting (and as a general rule, if you won't do that you should not offer Article 15, either).

I would recommend having the Soldier re-write with the clarification that she use her own words and cite sources if she is going to use them.

To all those who criticized the misspelling, I hope that is not the sole criteria you use to judge the competence of NCO's. My criteria includes living Army Values, the NCO Creed, and taking the time to care if subordinates adhere to standards. Also, notice that the essay was corrective training, which is different than punishment.

In Kuwait we could do this at the MWR recreation center by the water on the old CP Doha. The Prince has turned over a recreation area to the soldiers becaus eit was by some smoke stacks, so when I had a day off, I laid out by the pool. However, in Afghanistan and Iraq the closet you will come to laying out is running in the 120 degree weather in your shorts around post. You know having very little cloths offends Muslims! You must be fully dressed when going outside the wire. You are in a Muslim country, you will learn quite quick and being without your gear you can run into an IED anytime and anywhere.

Whats wrong, miss your high school days?
Going to have a Solider write on the chalkboard next one hundred times.
Geeeeesh, do the Army a favor and ask for a discharge right away.

Listen to your boss. Soldiers can't be expected to follow orders they are not given. Do me a favor and get out of the Army when your enlistment is up.

I doubt there is actually an Army publication covering plagiarism.

First things first, failing to follow the directions of your NCO will land you in the CSM's office and you may be the one given corrective duty.

IF you failed to clearly state the parameters of the original exercise, you are at fault for such failure.

It seems that you haven't been to any of the advanced schools to be making this compound mistake.

If you feel that you are correct everytime you say something, you won't be in uniform very long.

The objective of all corrective actions are to teach, not to punish. You seem to be bent on the punishment aspect. Get over it and be professional, learn and train.

So cute. Okay, probably Article 134 of the UCMJ, the general article that covers anything prejudicial against order and discipline.

Keep in mind that Article 134 is usually handled by NJP but she has every right to demand a court-martial, in which case, it's very likely to be dismissed.

If you're going to use it as a threat, also make sure of your own integrity by advising her of her rights.

You don't need a reg for "didn't do homework" you need to use the one for "didn't do what the hell you were told."

Your boss is wrong, you told her to write an essay, not copy one. She blew you off on purpose. Joe is going to test you, if you give, they're going to lose respect for you and nothing you say will matter to them. Then they're going to tell they're buddies you wont hold them to a standard, and now you have multiple soldiers who think its ok to do what ever they feel like, when ever they feel like. If you're in charge take charge, if you don't they will. These people are grown adults and need to be held accountable like grown adults.

If your to silly to research AR's why should you be on her about the essay?
proper spelling would help
A GT score higher than a 90 would help alot too
I would have loved to have read the counseling statement.

Just have her do it over (and tell her not to this time)

save yourself the time of looking for a regulation that may not exist.

I think you are well within your authority to not except a cut and paste paper.

(have her hand wright it so if she does copy she at lest had to waist the time writing it)
