hi, I was assaulted by 2 females at work, I had two detachments in my retna (corrected with laser surgery) and I am in therapy for post traumatic stress, depression and anxiety for which I am also on medications. my question is: I have a lawyer working on my workers comp claim and I don't have to pay him unless I win my case, the problem is that this has become too overwhelming for me, my nerves are shattered and I no longer want to go through with my case, what can I do? this is not a joke, I am very serious and I need for this to be over! I can't take this anymore! please! I live in pennsylvania, thank you

You can't cancel the claim.
You CAN fire the lawyer.
Did the workers comp company deny your claim? Is that what this is about? Otherwise, there's NO POINT in having a lawyer if the company has accepted your claim. They can't get more money for you, and they take 30% of what you get.

I really don't know but went through one of those claims and it was terrible. I was never treated so badly in my life. Just a thought-if you do get out of it, you will probably end up owing your attorney something. You signed something with him and you probably agreed to go forward with the case. When you stop the case, you are breaking the bargain and he won't be free. You need to talk to a shrink or clergy or someone that can help you get the strength you need to go through the ordeal. Don't give up, you deserve what you will get and if you need further medical treatment and don't go thru with it, you will have to pay for it. Usually any medical treatment associated with a workers comp claim will not be paid by any other insurance. So think it all over very carefully and do what is best for you in the long run. I have the same problem. I hired an attorney and I am not getting any answers. I have been on it now for 2 years and I am literally going insane sitting here. I can not perform the job that I was doing, but I am wanting to find a job that I can do and get off workers comp and go back to work for my health and sanity !! I can t take this any longer. I am an active person, but can t sit and wait. I have gained 35 lbs since I got injured and it is taking a big toll on my self esteem and life !

I don't advise you to withdraw your claim. However, I DO advise you to get more assistance from your therapist. I understand that injury claims can be very stressful but, if your attorney is doing his/her job, you should be shielded from a lot of the stress. I suspect that your PTSS and depression are key factors in why you are feeling the way that you are. Talk to your therapist. You may need more intensive emotional help and support than you are currently getting. If your therapist isn't helping, give serious thought to another therapist who can be more effective. Talk to your attorney and let him/her know how you are feeling. Don't withdraw your claim, however. I'm sure your attorney has already incurred many expenses in your behalf that will need to be paid by you if you withdraw the claim. Also, your emotional condition, if related to the attack, as well as your physical injuries, may require ongoing care and treatment. If you withdraw your claim, your regular health insurance isn't going to pay those bills if they are work-related, resulting in even greater financial obligations to you. Because of the PTSS and depression, you need some additional support and understanding so you don't feel so overwhelmed. Are there any support groups your therapist can recommend? Is there a different medication that might be more effective than what you're currently taking? Can your attorney give you a little more space or assistance since you're feeling so overwhelmed? I suggest that you print out your question and give it to your attorney and your therapist so they can see how you're feeling. I know it's hard to ask for more help, but they need to know how you feel right now in order to give you the support you need. Good luck.

Read the contract you signed when you hired the lawyer. Most likely, if you fire him - you will owe him for his work so far. Lawyers in my area charge $125.00 per hour plus expenses.
His contract may be a "I don't get paid unless you get paid" but I would bet he's got some kind of provision that prevents you from walking away just cause you changed your mind and left him holding the bag.
Since you hired an attny - I suggest you make an appointment to sit down with him and discuss your concerns. He may be able to take some of the stress off your mind.

My belief is that this question isn't so much about insurance as it is about how we as humans choose to react to different situations in our lives.
You did not choose to be assaulted, but you do have a choice in your recovery and well-being.
The reality is that you have done everything right to this point. You sought outside help, i.e., an attorney and physicians to help you in this matter. You turned over the situation to others more qualified than you to work in your best behalf. They understand the law, they understand depression and anxiety. The problem is that you have decided to take back control and this is causing you much fear, to the point now where you just want it to end. This is not the answer, and on some level I think you know this.
Leave things as they are. In your mind, turn things back over to your attorney, your doctor, and most importantly, God, (which isn't your attorney no matter what they say!) Pray for the two females that assaulted you, that they find peace in their lives.
It can be over in your mind if you choose to let it be over. It's in others hands now, let them do their job. You do the next right thing indicated, which is to get healthy again so that you may be of maximum service to others.
