I know an American citizen in Angelton, TX who is trying to abopt a 22 year old illegal immigrant from Brazil. He is illegal right from start as he crossed borders. I know that person cannot adopt him, but he is filing him as a dependant and getting a huge tax returns back from IRS. How does that work? Is it illegal?

No it's not legal. And you can only claim a dependent with a social security number, which this illegal immigrant wouldn't have unless he has a false or stolen one.

Either your acquaintance is making all this up, or he's setting himself up for huge problems if and when he gets caught.

He's blowing smoke up your backside.

For one thing, dependents must either be US citizens or legal residents of the US, Mexico or Canada. As the illegal is from Brazil, he or she cannot be claimed as a dependent by anyone, even his or her parents.

For the other thing, the value of a dependency exemption is $1,190 or less. For most taxpayers, it's worth either $510.00 or $850.00. In my book, none of those constitute "huge tax returns back" from anyone especially the IRS.

Lastly, you don't "get" a tax return. You FILE a tax return. You may or may not get a refund depending upon your tax liability and how much tax was withheld but the bozo making this claim is clueless of the law and is making up stories to try and impress someone.
