IN MY WORK I WORK 12 HOUR SHIFTS..
MY BOSS IS GOING TO CHANGE MY HOLIDAYS TO HOURS AND NOW I OWE THEM HOURS , WHEN I SHOULD HAVE 8 MORE DAYS TO TAKE..

I HAVE TO WORK TILL APRIL 08 TO GET A DAY OFF OR WEEK OFF

THANX FOR YOUR KIND HELP. I AM IN THE UK HAVE WORKED FOR EMPLOYER FOR 6YEARS AND HAD NO PROBLEMS WE ARE NOT IN A UNION... PLEASE HELP,
NOW I WILL HAVE NO TIME OFF WITH KIDS AT CHRISTMAS, BIRTHDAYS OR MY ANNIVERSARY..

No, no and no, don't know all ins and outs. Do one thing find "ACAS" in the telephone directory, there's local branch in every town put you case to them, they will give you sound advice. good luck.

If you are in Australia, this would be illegal and your boss could face criminal charges!

If you are in the UK, I would think there are labour laws that would give some protection, check with you Union representative for more info.

In the US, you may have to enquire with your Department of Labour or a lawyer.

In any case, changing the rules half way through the year does not sound legal, as the employment year is a form of contract.

It seem unlikely to me that one party could just change the terms of a contract in a way which disadvantages the other person, without discussion or agreement.

Seek professional advice about this, it sounds like your boss is trying to take advantage of you!

Have you got a Contract of Employment? Check it out, if so, before you take things any further.

You say other members of Staff unhappy with changes made, there is strength in numbers.
List your objections, ask for an informal meeting with new boss to discuss things. If you don't come a reasonable compromise make an appointment to see your new Boss's Superior. Good Luck

i would of thought there is a rule against this, has it not affected all the other staff, if so get your heads together and find what can be done as a group.

as far as i am aware the law entitles you to 28 days and it does say days not hours paid leave if you are in full time work.

if you get no joy i personally would go to your local paper and kick up a stink or leave and take the to court for unfair dismissal (you can do this even if you left if they have made things awkward and hard for you)

good luck as it does seem very unfair

A change such as this is a change to your terms and conditions.
This ought to be negotiated with you and your union, although your employer can give you notice to terminate your old contract and introduce these new terms/amendments. The notice they must give will depend on the amount of time you have worked their (and possibly your contract). The minimum notice required is 1 week for every year you have worked - up to a maximum of 12 weeks.
Your union should deal with this issue for you.

No matter how your boss changes the way holidays are worked out you have a legal entitlement to holiday. Even if your boss changes your holidays to hours it does not affect how much time you have left to take off. He has clearly made a mistake.

I recently had something similar,although I didn't loose as much time as you did. We used to get 12 sick days a year, they took away 3. With no union we suck it up. No days off at all until April? I don't understand that.

which country are you located in.

likely what you are talking about is a Department of Labor issue, if in the USA. see link to them below.

at the least I do not think they can change your benefits to where you "owe" them after the fact. in order to be legal and legit they would have to say something to the effect "Starting October 1, 2007 the following policy change is going into effect"

if you are union,( which from what you are writing here I take it your likely not), contact your union steward and in a worse case senario you could contact the NLRB if your union does not support you.

No. Your boss can not change your holiday entitlement, if you are a member of a union I suggest you speak to them asap or visit the Citizens Advice Bureau. I hope this info is of help to you.

No I dont think he can do that if it's not written in your contract...plus they cant just change their mind half way through the year either, you should go to your local citizens advice centre even if you're not in a union you still have rights!

surely he has to wait till that year is finished before he starts new rules. every year you are entitled to 4 weeks holiday no matter how many hours you do. talk to citizens advice there no. is in the phonebook they will be able to give the exact information on what the current law is
