does anyone know that statue of limitations for people that were caught shoplifting at a store (person was fined and only civil lawsuit was brought up) how long does a person have to wait to go back to that store?

i doubt there is a limit , but with the turnovers in business , i doubt they will remember you unless you cause trouble. then they will pull out that ban and get you in even more trouble

There is no statute of limitations on a business' choice. What this means is that it is up to the business in question to decide IF and when to allow the person in question back onto their property.

It is an internal policy so even if the person was not fined, taken to court, the store could ban them indefinitely. Most civil trespassing notices (handed out by mall/store security guards) state a period between 2-3 years.

The courts/police might have given the person an order to stay away for 12 months. If the person goes on to the property within that time and the police catch him he would be dealt with by the courts alone for a criminal offence.

But if the store/mall says they don't want the party there for 36 months(or what ever period of time), then the party would still be trespassing and liable to prosecution if caught and reported.

They usually mention it to you as they write you up your tresspass notice. If they don't mention it, assume that you're banned forever (or until they forget how your face looks....no one will arrest you for tresspassing if they don't know who you are). Also, depending on where you live, this type of tresspassing isn't criminal (for example, in Ontario). And how was a civil suit brought up for theft? That's a criminal matter.

Don't go back.

Don't be the blockhead that gets arrested for "returning after being forbidden."

The trespass warning is permanent. They DON'T WANT YOU BACK IN THERE.

Is that plain enough?
