Seriously, what are the odds of a narcotic unit doing things that arent legal (such as searching a home w/out a warrant and making a plea agreement and then reniggin' on it)?? Cuz this happened to my husband....wanting to see how common it is.

First of all, my husband DID have marijuana in his possessions but it was NOT his, he was keeping it in a safe place for someone that lives with us. Though, I know that makes him guilty (and stupid) for even doing that....he's not some kind of dealer, like the cops are trying to label him. They DID NOT have a search warrant, we've asked. And came to our house under probable cause (someone made a phone call reporting my husband had over a pound of weed and was growing over 50 plants---more than NOT TRUE). They found no plants and only found less than an oz. in his stuff. We were told by the police dept. that he had to give them permission to search...which he didnt.

i think there are some very hard working policemen and women. I also think there are some corrupt ones. In answer to your question .... how many do things illegal. I'd guess 50 percent of all police are corrupt.

Some of the answers here... I just don't now where these people come up with their info. Everyone watches the news, many read the paper. People held up to a higher standard (public officials, police, firefighters, EMS) all are targets of the news media when things go wrong. Little is said of the thousands of drug abusers, drunk drivers, child abusers, embezzlers, and so on that are arrested hourly by the same officers we place accountable to that higher standard.

50% !! youve got to be kidding ! 50% corrupt ? No way, not even close.

I personally know at least 100 officers within this county due to my position. And judging by there performance and history this type of statistic is just not possible. People need to understand the law before jumping on the bandwagon that there rights have been infringed. Maybe look into just what is required in order for an officer to determine he does NOT need a search warrant first. This can explain a lot.

People watch too much TV.

In Super TV Land it happens all the time, in reality seldom.

Its a common misconception that searches without a warrant are illegal. There are plenty of legal reasons for a search to occur, without it being "dirty cops". If a judge rules the cops actually needed warrant and they didn't have one all the evidence would be thrown out as "fruit of the poisonous tree".

Cops don't set up plea deals, so they couldn't renege or even "renigg" on it.

Perhaps a more apt question would be "Chances of a dirty husband?"

Searching a house without a warrant would be pointless. Any evidenced obtained would be thrown out. Unless they had really good probable cause. I'm sure they had a warrant. If they went to court and had no warrant, probable cause etc they would most likely face charges themselves. I highly doubt they had no warrant. Many times people assume things from TV and are often very wrong.

The Police don't make plea deals. They arrest and present charges to the prosecutor. The prosecutor makes plea deals and the judge ultimately signs off on them. The police may be able to recommend more lenient treatment based on cooperation, but no they do not make plea deals. Anywhere.

First, are there bad cops yes. Do they do illegal searches, yes. Will the Court throw out a bad search, yes, happens all the time. Can they not go through with a plea agreement, yes, because they can't make a plea agreement. That is up to the prosecutor to do. Can the cops work someone, yes they can. Is it legally binding, no. Can the prosecutor make a contract with a defendant, yes. Is it legally binding, yes.

Note, not all searches need a search warrant.

Searching a home w/o a warrant is usually not a crime. It is "illegal" in that the laws of search and seizure were not followed. The information gained in the search is not usable in most cases. But it is seldom a crime.

Breaking a plea agreement is not a crime either. It could be unethical and it could hurt the court system's credibility. But first, cops can not make plea agreements and therefore can not break them. If your husband fell for a plea deal with the cops he is an idiot as well as a dirt bag.

There are dirty cops, unfortunately. It is possible that a plea agreement could be reneged on, just as it is possible that a home could be searched without a warrant.
It is also possible that the cops found drugs in your husband's home and that your husband deserves to be convicted for the crimes he committed.

I don't know how common it is in my city, but I don't think that they would search a house knowing they plan on bringing this man down in the court system without the proper paperwork or go ahead from someone in the house because that would eliminate all the evidence.
