To buy alcohol in the US you have to be 21y/o. To drink in public venues, you have to be over 21 or the supervising adult can be convicted of child endangerment or contributing to the delinquency of a minor. Many parent based on their cultural background can and will often give their children wine, etc in the home, this is not prosecuted, unless the child leaves the home or is reported to child protective services as frequently abusing alcohol. This is normally limited to a 1/2 or full glass at dinners etc and is not at the liberty of a non-legal guardian. If your "guardian" is a friend who is 21 when you are 19 then they would not have any authority to provide alcohol.

the drinking age in the US is 21 yrs old. doesn't matter what state you are in. sometime in the 80's the federal govt forced all the states to change their ages to 21 under threat of losing federal highway funding. i don't believe there are any loopholes other than maybe wine in church or something along those lines. i don't think the under the guidance thing works, because every year you hear about "adults" that get arrested for supervising parties where people under the age of 21 are drinking.

The drinking age is still 21. If the guardian allows you to consume alcohol, they are commiting reckless endangerment, as well as a bunch of other crimes.

You have to be 21. There are a few states where you can drink if you're under 21 under your parent's supervision, but New York isn't one of them.

It is illegal to buy alcohol unless you are over the age of 21. It is also illegal to provide alcohol to someone who is less then the age of 21 (so if you are drinking under the guidance of a guardian then that guardian is in legal trouble). There is no law against you for drinking if somehow you get your hands on some alcohol.
