Yes it is unfair - especially when they advertise "unlimited" usage. I heard of Comcast doing this to their customers. This practice is certainly of questionable legality.

I think it is fair. Internet providers have to pay for the internet per gigabyte so when they sell to people they are selling accounts intended for not commercial use. The terms of service specifically state that you cannot set up a server. But that is exactly what P2P programs are is a server where people can get files off your computer. The reason the internet is so hideously expensive for most users that only surf a little bit but want a decent connection is a lot of people use the connection like an always on commercial connection.

An analogy I used earlier was like a city that plans for each person to take a shower and water there lawn but then there are people who hook up a fire hose and leave it on 24/7 so there isn't enough pressure left for other people to get a proper shower which drives up the costs for everybody.

If you want a firehose then get a commercial connection and pay per gigabyte just like the isp would.

Yes! They sign a contract to agree to a certain amount of usage and they break that agreement!

Happens here too!

Yes, Unless they either set a limit (In a Written Contract) or if they find definate Abuse of their policies (Sending Spams)
