God forbid we should start a war of aggresion (The crime hitler was convicted of at the hague) or commit war crimes according to the geneva convention.
But if it ever happened, even by a high member of our government,

No, Gary, honey, it will never happen.

Of all the wars you know of, have you ever seen The US take any ones land or country?

Of course, if war crimes are committed in violation of the Geneva convention then the violators should be prosecuted, American or otherwise.

However the crime of waging a war of aggression has no binding force in international law. In short, there is no international entity that can prosecute a head of state for waging a war of aggression.

Heads of state can be prosecuted for war crimes, but not for waging a war of aggression.

(note: you have to love those conservatives... innocuous question like this and the anti-democrat insults start flying!)

Unlike the rest of the "World" there is a Constitution which TRUMPS international law.
1. Non signatories have been accorded the Geneva protocols
2. Jurisdiction where are your "International Police" isn't amazing that the United States does that job!
3. Is it not amazing that so few soldiers and marines have been convicted of war crimes, notice the charges were thrown out.A mere handful convicted, I understnd your bitterness but then you are a liberal and by the way OBL loves you.

Sorry, international law would not usurp sovereign rights. You'd be hard pressed to make a case of war crimes against government leaders, if that is your drift.

If international law is so important to you, where is the outcry about Darfur? How about the crimes that were committed against the Iraqi people by Saddam? How about the treatment of Christians in the Sinai? Do you need more examples of the hypocrisy of your position?

It depends on what exactly you mean... if you mean should Americans who actually commit those crimes be subject to international law.. then yes, of course. If you mean should all Americans be punished by the acts of a few powerful people at the top.. then no. However we should be ashamed we ever let it happen.

I realize the Democrats have been saying it's OK to grab your ankles and apologize after a fight.

But seriously, it's not a good idea.

Yes, God forbid we should ever start a war of aggression, we should only fight those non-aggressive wars where no one gets hurt.

and JFTR losing is how you wind up in the Hague.

Ofcourse. NO ONE SHOULD ASSUME THAT THEY ARE ABOVE THE LAW.

US has committed more war crimes than Nazi Germany, Soviet Union, N.Korea, Iran, Iraq and China combined

China is gonna crush them anyway. Hah

They actually are. You may have heard of the Haditha killings and Abu Ghraib. There are other cases. I'm confused as to how Saddam invading Kuwait wasn't an act of aggression. I'm also unclear on when Congress declared war.

At present, the United States IS the international law. Judge, juror and executioner. As it stands, the U.S. can do no wrong. By the time the U.S. descends in power everyone will have forgotten their crimes.

Tiger-fyi: During the Nazi trials all countries expected the Nazi's to get the death sentence. Surprisingly this country didn't want it and some may have gotten off. How that has changed now with the torture camps.
