Your question is unclear. First off, you indicate that there is a 'First' surveyor. Then you indicate a survey in 2010. But you do not indicate how they compare in their findings??? Are you saying that the second surveyor found a 10 foot discrepancy. If the two surveyors have disagreed by that much there needs to be a substantial reason why. Assuming they were both hired to do the same task (set property corners?), then you need to contact BOTH of them and provide each with the copy of the others survey and ask for an explaination. Once you have that explaination (and if it makes sense).. THEN you can deal with the location of the posts.. In the meantime you need to notify the neighbor that there may be a problem with the survey which may relocate the line back to the original location and therefor you are concerned about his recent relcoation of the posts. Tell him that once the survey is straightened out it may be necessary for him to move them again and so you recommend that he not make any changes based on the second survey until that time. This letter (do it in writing of course) protects your rights as a property owner while you challenge the surveyors' findings .
