On one Saturday, I planned to eat lunch at a local restaurant. When I arrived there, the parking lot in front of the restaurant was full so I drove to a nearby parking garage and found a spot with free 3 hour parking sign clearly displayed on the wall and the whole first level was almost half empty, including the spot next to mine.
After I finished the lunch and left the parking garage, on the way back home, I was surprised to see a ticket by the windshield. I stopped and took a look at the ticket and was shocked that I was fined $250. I went back to the garage right away and checked the spot that I parked , at that very moment i realized that it was a handicap one! I couldn't believe what happened. I never in a million year imagined there was one handicap parking slot hidden between 10 regular parking slots. I swear that I didn't see the handicap sign while parking. As I said that there were many empty spots and the one next to it was empty. Please advise me if I shall fight for it

Pretty tough to fight it. You even admit that when you went back you could see it was a handicap spot. You were just in a bit of a hurry the first time. You need to chalk this one up to experience.

It was a handicapped spot. You parked there. It seems that the prosecution will not have a hard time proving the elements of the crime...

It will never hurt to talk to the prosecutor or judge to see if you can get a lower fine, but I seriously doubt that you will be acquitted...

You won't win, friend. The only thing that counts is you didn't have a "handicapped" license plate or the "handicapped" placard hanging from your rearview mirror while your vehicle was occupying that spot. Apologizing to the judge and bringing to his attention that the spot wasn't labeled clearly enough MIGHT get your fine lowered but don't count on it.
