A legal separation really isn't legal until a petition is filed with the court and the court enters its order for the separation.
The legal separation can make orders regarding freezing of marital assets; custody of the kids; child support; child support; spousal support; etc.
The most practical reason for a legal separation is if a couple has substantial assets and don't really want to divide them (such as ownership of a company; large parcels of real estate). Also, for health insurance purposes (if husband has wife covered on his insurance, she can continue to get coverage thru his employer at the cheapest rate rather than COBRA coverage at the higher rate for only a couple of years). Basically, its for the couple that doesn't want to be married, but it is too costly for them to divorce.

A physical separation while people get their act together and prove they can be full partners in the marriage sometimes has to happen, but a legal separation is the first stage of the legal divorce process. Hmmm.

A legal seperation "freezes" all of the marital assets so that one of them can't wipe out all of the bank accounts and leave the other partner with nothing but debt. Or would you rather be the one stuck with all the bills with no money to pay them? A legal seperation does NOT make it so either party can date. A legal sepeartion is NOT a disillusionment of marriage, the couple is STILL married...they are just covering their butts.

Legal separation, means you are not living together anymore, but you are still married. If you date others and have sex, you are still committing adultery.
I don't agree with it my self, but some think it is a cooling off time for troubled marriages. Instead of separating you should be getting counseling to make the marriage better. A separation makes one more vulnerable to the temptation of lust and adultery.

it gives each party a time to cool off and time to think of what is best..
even if they love each other...
people don't want a divorce sometimes for the WRONG reasons...
it is a mutual agreement,, they will/can see others... and hopefully this way ,,, there will be no killing..
financial matter, and be taken care of...
lots of reason... each party have their own..
