my daughter was in daycare in july 2007, and her tooth was chipped and almost knocked out because a child was throwing batteries at her in her classroom. Their was no teacher present and that teacher and the rest of the faculty act as if they don't care. What kind of lawsuit would i attempt to file and what kind of injury is that? The lawyers that I have attempted to contact said that they dont do those kind of cases. I live in Mississippi and any information that you give is helpful. Thanks in advance

Well, good news is if that was a "baby tooth" it'll grow back. However, the daycare was irresponsible and deserves a law suit. Personal Injury is good, Child Abuse/Neglect is a possibility as well, also Premises Liability is an option.
The facts are it's a Personal Injury, no adult was in control of the situation so it could be considered Child Abuse/Neglect, and Premises Liability holds the owner accountable. Talk to a Local attorney for a broader understanding.

P.S. Hopefully you took pictures of the injury....

Mississippi is a national joke, a notorious judicial hellhole. Sleazeballs try to cash in on the lawsuit lotto. One notices that people only want to sue the productive business, and not the responsible violent child, nor the parents that failed to teach it self-control.

What is the consequence? Simple. Businesses leave the state, and the citizens get the economy they deserve.

You need to take any medical/dental bills that resulted from the injury WITH YOU to your first consultation.

Probably personal injury. You would need to prove that the teachers and/or the day care center were negligent.
