He is 18 years old and never been in trouble before. Just wondering what could happen when he goes to court. Probation?

Anything from a fine to community work service to being on a work crew. If you get a particularly hard judge, he may get a day in jail, but it's not likely. Since he is drinking underage, he may have to complete a chemical evaluation to determine if he abuses or is dependent on alcohol or any other drugs. If the area you are in has probation to court (basically unsupervised probation to the court, not the probation office), he could get that. Probably a very low chance of getting sentenced to actual probation where the probation office is supervising.

For Public Intox., just a fine. Drunk Drivers, Attend Area Substance Abuse, pay a fee to Mothers against Drunk Drivers, hefty fine and short time on Probation, loose Driving Privledges for a time, Increase in Insurance premium, possibly Risk Insurance, Second Offense becomes more severe.

Probation. When I was 20, I got a misdemeanor Possesion of a Controlled Substance to wit:Marijuana and I ended up getting 12 months non-reporting probration.

Have your son seek a treatment facility and the judge may even give a "clear the record" type sentance for completion of the program.

I don't know. I suppose it depends on the locality. Where I live, Arlington, Virginia, they lock you up for about six to eight hours unless you say you want a lawyer. In that case you get out when hell freezes over. Next you get a $55.00 ticket just like a traffic fine. You can go to court and fight it, but most people just pay the fine. Nobody admits it, but cops here and almost everyplace else have to meet a quota of arrests. Picking up drunks is easy. They're usually just sleeping in someplace weird and they're too groggy to put up any resistance.

I don't understand how people can say lose drivers license and insurance fees go up. PI is not a moving violation so how can it effect your drivers license or insurance? My daughter just got a PI and they are saying the same thing. A fine of over $500 and she could lose her license until she turns 21. I think this is BS so I will be contacting a Attorney to take care of this. This is in a small town in Oklahoma where I guess they think they can make their own laws.

If he wasn't causing a disturbance I would imagine he'll get a lecture from the judge and thats about it

I've never heard of people charged with Drunk in public getting penalized seriously

First offence, not driving is good. most likely fines and
probation, maybe court ordered to A.A. meeting, or out patient rehab, and or community service, Depends on your state and judge.

can they give you probation for a misdemeanor?

what happens if you break your probation? surely not jail for public drunk.

it is like a traffic ticket just that if you don't pay nor go to court on the given date a warrant would be issued. No his commander will not find out unless someone tell him/her. its really very minor i would not tell, but it is up to your son and how cool is his commander? if he paid for the ticket and he had no court date then the case is closed.
