My boyfriend has unpaid back child support. We live in Texas. We would like to get married soon, our question is can we get a marriage licence with him having unpaid back child support?

Yes I am sure you can. It will also be placed on public record.

Here are somethings you need to know.
If the two of you file joint tax returns any moneys you get back will go to child support if the federal government has been notified.

Do not have a joint checking account because it can be siezed.
If you are buying a car, home with your money do not put boyfriends or husbands name on it.

HE NEEDS TO START MAKING PAYMENTS EVEN IF IT IS $50 A MONTH. GET STARTED NOW.

PROOF such as cancelled check, money order receipts & stub.

If you pay by check in the memo make a VERY detailed list of what the money is for.

Keep copies of checks, receipts of anything purchased.

Good record of all payments.

Make payments on time.

Do not give cash if you do then go get a money order and document on it and the money order receipt a detailed message what it is for.

If boy friend is paying directly to child support enforcement they will have a print out of all received payments BUT STILL KEEP YOUR OWN RECORDS cause they can make mistakes.

Be careful trying to modifiy to a lower child support payment because many times they do not lower it but make it higher.

Child Support Enforcement can not do anything to your fiance if he is making his payments on time every month. But if he is every late they will become his worse enemy.

You want to marry a man who has unpaid back child support? Why? For one thing they will start garnishing his wages. If he gets far enough behind they may garnish part of YOUR wages as income to help pay them. He will eventually loose his driver's license...go to jail. Employers don't like it when their employees allow a debt like this to go unpaid...so he could probably loose a job...Any unemployment he would get would go directly to what is owed in child support...he wouldn't see ANY of the unemployment until the child support got paid up. Now, you want to marry this low life WHY? Are you willing to support him since obviously he's not going to have any means of support in the not to distant future...

first off , y would u want to marry someone who has
UNPAID CHILD SUPPORT? do u plan on having children with this man?? does he ever plan on paying his child support and actually supporting his children?? instead of worrying about getting a marriage license, try worrying about y u accept a man not taking care of his children and think he wouldnt' do the same thing to u. women like u make me go hmmmmmmmm. and wonder what happened to u guys???

I'm sure you can get married no matter what. But you will have to pay that back child support. The court ordered it. The kids deserve it. You could get married if he was bankrupt 8 different ways and had a nose ring that was attached to his probation officer. He has legal obbligations. Support him and help him meet them!

I believe you can get married while having an outstanding affidavit (owing money to someone who has filed legal paper work to obtain that money). You will not, however, be able to take out a mortgage if he still owes the money - provided the child's mother has gone to court to order the money to be repaid.
Plus do you really want to marry a man who will not provide for his own child? What makes you think he will do the same for you should you have children and divorce?

Yes.
Your question should be, Are we ready and able to get married? Do we have money in the bank toward our house, can we pay our bills, who will be responsible for what, and do I want a guy who obviously is not likely to be responsible to be father of my children. Love is not enough. Think about the reality of where you are heading. Why go there? Wait. If it is truly meant to last forever, then he will still be there later. Don't do it.

Yes, you can get a marriage license, but he may lose his drivers license AND his freedom, (jail) if he doesn't pay the child support. Don't have kids with him unless you want to be in the same boat as his ex.

Your not starting this marriage off on the right foot, have him get caught up on the support before you marry, do it for the sake of the kids

Don't worry, they can not come after YOUR income. The Boyfriend is the only one in your relationship that had a duty to pay. No it really won't affect either one of you inless he is over $1000.00 (for most states) behind. You stated that he is making payments though so I don't see why they would come after him inless he isn't making an effort to get the total amount owed lowered. Is he only paying his monthly obligations? Mostly those questions are for state records.

why would you want to marrying him with the balance of child support hanging over his head. once you marrying that balance becomes your problem as well. if he is not taking care of his kids what makes you think that he will take care of you and your kids. come on now give me a break. use your noddle. if it walks like a bum, and act like a bum than it is a bum. dont set yourself up for failure. you want to be successful and succeed in the marriage. tell him to pay that balance off and start proving to you that he is responsible and is a man that will take care of his responsibilities.
