I don't understand what you mean by "the insurance company wants to settle with me for the kids." Were your kids with you, and were they hurt? You should begin by filing a police report. Get a copy of the report. Call your insurance agent. Your insurance agent will represent you with the company insuring the person who hit you. If you were rear-ended, the accident is almost always charged to the person who ran into you, and you shouldn't have to pay for any of the damage to your car. If you or your kids were hurt, then you ought to contact an attorney who does personal injury work. She or he will often be able to negotiate for more than the insurance company will offer in settlement.

If the accident didn't create any concern of future medical complications or treatments, then the easiest thing to do would be to settle with the insurance company. You simply need to be paid for the value of your car, all (if any) of your medical bills, and any reasonable expenses that you incurred due to the accident. That should be fairly easy to figure based on your car's value and the cost of any treatment and you wouldn't have to sue and involve an attorney.

However, if there were injuries, you would need to be confident that the injuries were minor and that no additional treatment would be required. You would not want to settle quickly in that case until you could reasonable quantify your expected future costs. If you initially believe that there will be future costs, you are better off contacting an attorney to represent you with the insurance company. You may wind up accepting a settlement anyway, but at least you have someone that can correctly protect you from accepting a settlement that would create a shortcoming for you later. And, if the settlement is deficient based on your needs, then the attorney can step up and sue them for the appropriate amount.
