No it is not illegal but it is not a good practice wither . However some of the time a page may be valid and then the standard or validation tool gets updated or revised and it will make a page invalid as well.

When you find a page like you described it is not a bad idea to let the web master of that site know about it so they can correct it.

If you do this you are violating the use of a trademark or service mark. In most countries this is illegal and can result in substantial civil penalties.
