An American called Dennis Hope - he claimed the moon in 1980, as well as most other planets and moons in the solar system under a loophole in international law.
According to Dennis Hope at Moonestates.com, the UN Outer Space Treaty 1967 states that individual countries or organisations such as NASA cannot stake a claim to any planet or moon in the solar system, but astonishingly, didn't prohibit individuals claiming ownership of the moon or anywhere else. The loophole was noticed almost immediately and the United Nations have expended a large amount of time trying to ratify an amendment to the treaty ever since, that would explicitly include corporations and individuals from staking claims in outer space. All attempts at ratifying such an amendment failed because the main spacefaring member states did not agree with it. This later became the Moon Treaty of 1984 but never ratified by any of the space-faring nations as the USA in particular believed it would inhibit the exploitation of Lunar and other celestial resources for profit by corporations and individuals.
What we are left with is a law that clearly states that the Moon and the other celestial bodies are the heritage of all mankind for the purposes of exploration. So basically NASA (or anyone else) can do what they like and where they like, as long as they are exploring. But if someone wants to drill for minerals on the moon, that is quite a different issue altogether.

The Moon is going to belong to the groups of people that settle permanenetly on the Moon and has the fire power to defend themselves against future invasions, like how every other piece of Earth real estate is determined. Right now it belongs to no one because nobody has the ability to settle on it and so nobody cares

Nobody. The outer space treaty forbids governments from claiming any celestial body. A private person could claim to own the Moon, but what would he do if another person did also claimed it? No court has jurisdiction to settle the dispute.

no one. people buyt acres of land on the moon from time to time. but the people that are selling the acres dont even own them, u cant sell something that you dont own. thats like saying
"ill sell you the entire country of russia, 17 bucks" you can buy it and get a document saying you own it, but that doesnt really mean you own it.

My sister owns a small bit of the moon, her husband bought it for her.
She has a map showing the area, and also has a certificate to prove it!!!
