i want to be emancipated from my dad, but not my mom. how could i do this and is it possible?

I live with my mother and two brothers. My parents have never been married. My mother has sole custody of my brothers and I. She has been in a constant battle for the past 14 years with my father about visitation which he had, until, he abused my 13 year old brother when he was 7. We have been though 8 judges in the past 14 years, and now, we have a new judge. I understand that this new Judge Dandrea Ruhlman, Rochester, NY, will be forcing my younger brother (10) and myself (14) to have supervised visits at his house where the abuse of my brother (13) took place. They are trying to have his sister or his 80 year old mother supervise, however, his mother is petrified of him and his sister hates him. There is documented evidence in our court files that my father is a narcicist, abusive, controlling, and demanding. SPCC workers had court order of protection against him as well as some family members.

emancipation is the wrong word in this case

but your mom might get a lawyer that will allow her to get you to state your views on this matter
and your brothers

it might help things
if the judge has any smartz

This is a bit tricky. If your parents are married and living togateher, you cannot be emmancipated from either without being emancipated from both. If they are divorced you can attempt to be legally placed with your mother. Emancipation is kind of like divorcing your parents. It is saying that you are no longer dependant upon them and you wish to be considered as an independant person.

Not much info here. Are your parents married? If so, no. Getting emancipated, depending on your age, will be hard enough.

Not possilbe to emancipate from one and not both. Sounds like a custody issue.

emancipation generally means that the child uis self-sufficient and not under anyone's care and control
So a child cannot be self-sufficient from one parent and not the other.

You don't give enough details to even give advice.\

Do they live under the same roof? If so, you have a problem.
