People somehow find out the number for the gates, and drive in and park in empty visitor spaces, sometimes for the whole day, then drive out in the evening. We have put up a notice they will be clamped, but now we wonder if it is actually OK legally to clamp someone's car even if they have been warned they cannot park there and will be clamped if they do.

Why not just park vehicles behind them so they have to go and ask somebody to let them out? The embarassment may keep them away. I did that with a vehicle that was contstantly parking in underground resident slots at a complex I lived in in Edmonton. I blocked him in to keep him there until the police arrived. They happily ticketed him, and would have towed him except he came back before the tow arrived. It was an expensive lesson for him, and we never saw the car again. If they are opening a locked gate they aren't entitled to, perhaps they could be threatenend with break and enter charges. Check with the local constabulary. Check with management about putting in a new code, or even a second lock, with a key, or a passcard system. If a resident is passing on the keypad codes to an outsider, he/she should be evicted, of course.

Another thing, the complex is under no compulsion to provide security for the illegally parked vehicles. While they cannot be vandalized, there is no reason in the world air cannot "leak" out of 2 tires on any car illegally parked. Note, the tires cannot be slashed or damaged in any way.

Put an annonymous note on it advising that you cannot guarantee that the vehicle will be there when the driver returns or that it may be not be in a fit state, it will prey on their minds, I used to park my car ina particular street when I went to a football match every week kids demanded money to 'Look after' my car, I always refused and nothing happened, but shortly afterwards started parking elsewhere as I could'nt take the risk, if they continue to park there smear the windscreen with butter or take a large potatoe and jam it up their exhaust pipe, the car will conk out and they will be stuck. I think they would then get the message

You need to check the contract on your property. If you are renting, it is up to the owners of the complex to enforce any action against trespassers.

If the units are independently owned, they owners need to get together and talk to the owners of the land - ie, to whom they pay the ground rent.

There is a clear infraction of trespassing on private property.

It's all a bit up in the air really and you will have to do a lot of running.

The PSNI will be no help in this. Anyone caught clamping a car is likely to get in more trouble.

The alternative is to change the code regularly but then that probably screws up the rubbish collection and other people needing access to the apartments, like the postie.

Ultimately though it will be up to whoever owns the land to initiate any action against the inconsiderate parkers.

Clamping was considered in some parts of South America
but a cheaper solution is commonly adopted. Posted private property owners peel backing off an adhesive backed paper
which is of size and cut to cover most of a vehicle front windscreen; same application is hard to remove and vehicle owners feel motivated not to aquire one.

why not change the code for the gates when they are in there and charge £100 for the new code. Seriously they are trespassing. Put a notice up "Unauthorised parking £50 per day" then you can sue persistent offenders in the small claims court

(Hi im using my g/f's account) This depends on your local councils constituency.
For example in aylesbury if the grounds of which an unauthorized car is parked are private, You CAN clamp the car and request it to be towed providing you have signs within vision of standing 20ft away from the place in mention.

Check which your council or citizen advice breau!

Even though they should have all their windows broke out and
the tires flattened you can not be the judge and jury and executionist of their punishment and can only simply report the infraction....frustrating as it may be....

have the wheels off it and they will soon learn not to park.they cant prove you done as they should/nt be there anyway.leave wheels inside the gate they can put em on them selves.
