Patents are useless if the product in question is not a marketable product which is manufactured and sold to the public. The US Patent Office would not waste it's time issuing a patent on something that is illegal to obtain or use. So no, tobacco companies do not hold a patent for marijuana - in any form.

I remeber seeing a woman's magazine from the 1970s (it was either McCalls or Woman Home Journal) saying that tobacco companies had already trademarked names they would use if marijuana was legalized. If marijuana was legalized don't you think that the tocabbo companies would be the first to jump on the band wagon?
