A woman dies without a will. The only living relatives she had is one brother, and neices and nephews from both living and dead siblings. The one living brother dies before her estate is handled. She lived in New York.

It goes into her estate, then goes down the line to next of kin. An atty. will notify you if you are involved. Recheck on it in a couple months.

Most Americans die "intestate" as it is known if you kick it without a will.

If the estate is worth more than $100,000 it will probably go through probate, which is a latin word that means "proving the will". A judge will handle it. If the estate is small, the court will probably just appoint a trustee like the brother, and he is to distribute the estate and handle the accounts.

NY law , if you die without a will , the heirs have to go to court and claim inheritance. They will pay an outrageous inheritance tax, but can claim the estate if have all proper paper work.

Probate court will decide. The money usually goes to the closest next of kin.
