Ok so i was at the house and i drank a few beers waited bout half hour and went to pick up my check cuz i felt fine.. yeah i kno stupid stupid stupid.. but anyways i get pulled over because of my license plate light was out. the cop smelled beer gave me a breathalizer test. it came out as 0.069 and the legal limit is 0.08 so i was under the limit.. i walked his straight line fine and followed his pen.. went to jail and realsed the same night.. just wondering what you guys think and if i have a chance of winning this case and if not what do you think will happen.. the traffic judge in highland county doesnt seem to be to strict..

They didnt take my license because i was under the limit but did charge me with a dui, i go back to court in 6 weeks. im originally on probation for vadolism which was a 4th degree felony.. i doubt that im allowed to drink.. not afraid of jail time just worried about going to actual prison

The BAC limit for someone on probation is ZERO. Drinking usually violates your probation. I'm surprised you were released at all. your probation officer should have been notified of your arrest and could have revoked your probation.

If you are on probation, you might not be allowed to consume ANY alcohol, especially a DUI probation. Depending on what your original charge was (the one that you are on probation for) you could lose your license, lose your car, go to jail, pay a fine, be forced to take a class, do community service, etc. It is impossible to know without knowing why you are on probation and what the terms of your probation are.

Well did they take your license ? and if so, you do have a case pending in court. Are you allowed to drink at all on your probation ? If not you might a problem. Find a lawyer that has dealt with second on third time offenders and you should be ok.

you 'doubt', as in you're 'not sure'?

if you're on probation, particualrly for a felony, you learn, know and LIVE the terms of probation to the letter.

you need to contact your lawyer, and you need to figure out how you're going to tell your probation officer that from here on out, you're never going to break it again, even in the smallest way

you'd better get your sh it together, and you'd better do it quick

who pays for this checks / breathlizer checks / blood tests , who handles the administrative job of getting the restults to the evidence room ? How much does all this cost?
